What is Tier 2 Sponsorship License Application Process?

The process for applying for Tier 2 sponsorship licenses changed on the 1st January 2021 when the UK government’s new immigration rules came into place. The Resident Labour Market Test (RLMT) which was previously part of the process is no longer needed.

Applications for Tier 2 Sponsorship licenses must now be made online. Applying businesses must choose the type of license they want to apply for. This will depend on the type of worker you want to sponsor, i.e. what industry your business operates in.

The online application for Tier 2 Sponsorship Licenses requires some supporting documentation to be uploaded, for example, information on the individual who will be managing sponsorships within the business, and proof that your business has the appropriate systems in place to monitor sponsored employees.

The company shall have to identify the need for a specific job role in order to commence the process. This process is to ensure that the prospective employee is best suited for the job role.

We shall have to advertise the specific job role for a minimum period of 28 days. This shall have to be conducted as per the UKBA requirements and in light of the ever evolving changes in law.

Tier 2 Sponsorship Licence

A sponsorship licence under this category allows employers to employ foreign and migrant workers. As part of Tier 2 Sponsorship guidance, we will complete all necessary forms, prepare them for submission, advise you as to the most appropriate supporting documents, and ensure that these are all submitted.

Although not strictly necessary, we insist, in addition, on preparing a detailed cover letter, explaining the application and referring to the supporting documents in relation to the rules and guidance.

Tier 2 Certificate of Sponsorship (CoS)

Once the company has been registered as a licensed sponsor, we must apply for a ‘restricted’ or ‘unrestricted’ Certificate of Sponsorship (CoS) and then assign it to the employee.

Tier 2 Sponsorship Licence FAQ's

A Tier 2 Sponsorship licence can be applied for by any UK business providing they are a genuine commercial enterprise and have the need to fill a genuine vacancy that is recognised as skilled by the Home office. The company would need to demonstrate some basic factors such as appropriate HR procedures and need for hiring non-settled person.
After submission it can take between 2-8 weeks to get a decision on a sponsorship licence application. On average most licence applications are resolved within 4 weeks. One the licence is granted then the company can finalise the steps for the employee to make their visa application.
The Home office fees for a Sponsorship licence depends on the size of your company. For small and Charitable organisations the fee is £536. - For Medium or large business' the fee is £1,476 - A small business is one with annual turnover of £10.2 million or less and has less than 51 employees. For small and Charitable organisations the fee is £536. - For Medium or large business' the fee is £1,476 - A small business is one with annual turnover of £10.2 million or less and has less than 51 employees.
There is no legal requirement to have a lawyer when submitting a Tier 2 or Tier 5 Sponsorship licence. However due to the nature of the licence procedure any mistake will result in a refusal and in most cases a ban from applying for a period of 6 months, as such it is recommended to consult a specialist immigration lawyer.
