Under a UK passport, you will no longer be subject to immigration restrictions placed by the Home Office meaning that you can come and go freely. It should be noted that those with Indefinite Leave to Remain (ILR) enjoy a similar privilege however, unlike a British passport, ILR can be revoked.

ILR can be revoked if you have engaged in a criminal activity which leaves you liable to deportation. It may be also be removed if you have spent over two years abroad. The government has also stated that if you were granted leave as a refugee but cease to be a refugee, ILR may be revoked. Unlike ILR, citizenship cannot be revoked hence many choose to gain a passport as a safeguard.

Visa-free travel to over 120 countries

An additional benefit of the UK passport is the ability to travel across the world including developed countries such as Canada, America, Australia and New Zealand as well as Asian countries such as Hong Kong and Thailand. Britain currently enjoys freedom of movement with the European Union (EU) meaning that you will be able to travel across Europe, but this is set to end with Britain leaving the EU.   

Being able to vote and stand for public office

Part of citizenship is being able to engage in the democratic process and as a citizen, you will not only be able to participate in all elections but also being able to stand for office. Under ILR status you are still eligible to vote in national and local elections as well as referendums, so long as you are a qualifying Commonwealth citizen.

As a citizen, you will have access to full healthcare provided by the NHS and will no longer need to pay the Immigration Healthcare Surcharge which is set to increase to £624 per year. It is important to note that under ILR status you will also be exempt from this fee.

How to get a British citizienship?

The gain a UK passport you must go through the process of naturalisation which is the final step towards citizenship.

To be eligible for nationalisation you will need to;

  • Have held Indefinite Leave to Remain for the past 12 months and you must not have spent over 90 days away from the UK during this period.
  • You must have continuously resided lawfully within the UK for 5 years, during which time you absence from the UK can exceed 450 days.
  • You’ll need to pass the ‘Life in the UK’ test, also known as the British citizenship test, as well as an English language examination. The test for British citizenship is notoriously difficult as it based on history, culture, politics and even sports. It requires a great deal of dedication but many of applicants are able to excel with our support.
  • The final requirement details that you are a person of good character which essentially examines your criminal record as well as previous immigration history.

Exceptions

If you are a married partner of a British national or a European national there are different requirements for naturalisation.

A married partner of a British national is required to:

  • Have held Indefinite Leave to Remain
  • Not been outside of the UK for over 90 days
  • You must have legally resided in the UK for 3 years and absences must not be over 270 days
  • You must pass the “Life in the UK” test and pass an English language examination
  • As before you must also show that you are a person of good character.

European Nationals

If you are a European national or a non-European partner you be required to

  • Reside in the UK for 6 continuous years lawfully
  • Not have an absence from the UK in the past year which exceeds 90 days
  • You must have held permanent residence for 5 years
  • During the last 5 years, you must not have been outside of the UK for more than 450 days, and no more than 180 days during a single absence.
  • You will also be required to pass the “Life in the UK” test and pass an English language examination
  • You must show you are a person of good character this is a subjective element that we shall explain.

It should be noted that if you are an EU national currently residing in the UK you should apply for the EU Settlement Scheme which will guarantee you a further 36 months leave. Whilst the deadline for this scheme is the 30 June 2021, you should secure your leave before the end of the transition period which is the end of this year.

British Citizenship through Investment

Step 1 – Choose an option

Firstly, it should be remembered that there are actually two main option to obtain an visa by Investment set out below, but there might be more based on your circumstances, our lawyers can advise on the telephone, in person or by email as you need.

The options are:

(a) The UK Investor Visa – a 2 million pound UK investment – a relatively large sum but a great deal of flexibility – more focused on passive investment.

(b) The UK Entrepreneur Visa – a 200,000 UK investment, much lower but the program is only open for those who will actively join or commence a business in the United Kingdom – an active investment. The applicant will need to speak English and present a business plan that covers key points that the Immigration Authorities wish to see. We can assist with the business plan preparation.

(c) Please also be aware that Cyprus citizenship which can be purchased within 3 months also allows for instant residency rights in the UK with no residency requirement.

Step 2 – Preparation

This is where our lawyers assist. We prepare the forms, the supporting documents, we advise on which evidence must be included, speak to third parties – essentially take over the entire project and manage it to completion. We assist in obtaining the initial visa right to the point that you obtain UK Citizenship by Investment.

In summary, for the Investor Visa, we need to prove that the applicant has 2 million pounds in liquid funds inside the UK or outside the UK, this is through a specifically worded letter, another letter or bank statement will not do. We must also prove that the applicant has an investment account, not a basic retail account open in the United Kingdom, again this is something we can assist with.

For the entrepreneur visa, the position is more complex, we have to provide specific evidence of English Language ability, of the 200,000 being set aside and being available for the future business. Most importantly, we will also advise on preparing a business plan for the business that the applicant ideally wishes to set up when coming to the United Kingdom, although they can always choose a different business once they get here.

Step 3 – Applying for British citizenship by investment visa

This process is simple, we make the application online, and the applicant simply attends an appointment to give fingerprints and have photos taken, in most cases no questions asked, we answer any questions that might come up. The visa is then granted in most cases in a number of days and the applicant can use the visa straight away.

Step 4 – Extending the UK Visa

The visas are then extended, having been initially granted for 3 years and 4 months (in some cases 3 years only). For investor visas, applicants are largely required to prove they have invested the 2 million in funds and have remained invested. For entrepreneur visas, the applicant has to prove he has become a director of a UK business, invested the 200, 000 GBP and hired at least 2 persons. The visa in both cases is extended for 2 years. After 5 years in total, permanent residency can be applied for.

STEP 5 – PERMANENT RESIDENCY AND NATIONALITY

After 5 years, permanent residency can be applied for. In the UK, this is known as Indefinite Leave to Remain, or settled status.

This allows for a person, with very limited restriction to live in the UK, to leave and to re-enter. The rights are very similar to a person’s right as a British National.

But to become a UK Citizen by investment, then the applicant must wait another year, and remain in the UK for the majority of the year.
